Terms of Service

1. Acceptance of Terms

By accessing or using the Service at lastwar.farm, operated by Michael Ketzer, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

We reserve the right to update or modify these terms at any time without prior notice. Changes are effective immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of the new terms.

2. Description of Service

The Service is a web-based platform designed to help Last War game alliance leaders track and manage their alliance performance. The Service provides:

  • AI-powered screenshot parsing to extract game data
  • Tracking of member statistics including power, kills, VS points, and donations
  • Storm event participation management
  • Officer management and collaboration tools
  • Optional public statistics pages

The Service is intended for personal, non-commercial use to manage your game alliance. Any commercial use requires prior written approval from Michael Ketzer.

3. User Accounts

To use the Service, you must create an account using a valid email address. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

You must be at least 13 years of age (or 16 in some jurisdictions) to create an account and use the Service.

4. Subscription and Payments

We offer a free 7-day trial period. After the trial, continued access requires a paid subscription.

4.1 Billing

By subscribing to the Service:

  • You authorize us to charge your payment method on a recurring basis
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You are responsible for keeping your payment information up to date

4.2 Price Changes

Prices may change with 30 days notice to existing subscribers. Continued use after a price change constitutes acceptance of the new pricing.

4.3 Refunds

Refunds are handled in accordance with our Refund Policy. Please review it for details on eligibility and the refund process.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any laws
  • Upload content that infringes on intellectual property rights
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service, servers, or networks
  • Use automated means (bots, scrapers) to access the Service without permission
  • Share your account credentials with others
  • Resell, redistribute, or sublicense access to the Service
  • Upload malicious content, viruses, or harmful code
  • Harass, abuse, or harm other users
  • Impersonate any person or entity

6. Intellectual Property

The Service, including its original content, features, functionality, design, and branding, is owned by Michael Ketzer and is protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any part of the Service without prior written consent from Michael Ketzer.

7. User Content

You retain ownership of any data you upload to the Service, including screenshots and alliance information. By uploading content, you grant us a limited, non-exclusive license to:

  • Process and store your content to provide the Service
  • Use anonymized, aggregated data to improve the Service

You represent and warrant that you have the right to upload any content you submit and that such content does not violate any third-party rights.

We do not claim ownership of your game data or share individual user data with third parties except as required to provide the Service or as required by law.

8. Third-Party Services

The Service uses third-party providers including:

  • OpenAI for AI-powered image processing
  • Paddle for payment processing
  • Resend for email delivery
  • Vercel for hosting
  • Neon for database services

Your use of the Service is also subject to these providers' terms and policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • AI-powered data extraction will be 100% accurate
  • The Service will meet your specific requirements
  • Any errors or defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MICHAEL KETZER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Business interruption
  • Cost of substitute services
  • Any damages arising from your use of or inability to use the Service

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Michael Ketzer from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you upload to the Service

12. Termination

We reserve the right to suspend or terminate your account at any time, at our sole discretion, without prior notice, for any reason including but not limited to violation of these terms.

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your data after a reasonable retention period
  • Provisions that by their nature should survive termination will survive (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law)

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Germany.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Michael Ketzer regarding your use of the Service and supersede any prior agreements.
